Social Economic Zone commonly known as SEZ has now become a major source of economic growth for India. The SEZ in India is not only intent for an economic growth but also to provide highly developed infrastructure with a good financial package. Today SEZ have become a large attraction point for not only domestic but also for the foreign investment. SEZ in India gained its function from 1st November 2000 to 9th February, 2006, under provision of Foreign Trade policy. SEZ in India is provided with a limitation or specific requirement of land that would be approximately 67680 hectors, which further divides into two specifications or area’s;

1- Processing Area – here SEZ units comes up.

2- Non Processing Area – here supporting infrastructure is created for the SEZ unit.

What really interests the investors or the purchasers would be the objective or an idea behind the SEZ and to understand that we can refer to the Social Economic Zone Act, 2005, passed by the parliament on 23rd June 2005.

The brief objectives are stated below;

1- Generating of additional economic revenue

2- Promoting export of goods and services

3- Promoting of investment from domestic and foreign sources

4- Creating the employment

5- Development of infrastructure facilities

With these simplified objectives becomes common to receive numerous application for the SEZ required area. It would be interesting to know that there were 531 formal applications received by the government till date to which there has been approval granted to 174 applications only.

It is mandatory for us now to know about the application procedure and what happeneds to those applications for SEZ in India. The application is posted to the Central Government who further posts them to Board of Approval consisting of 19 members.

SEZ in India follows certain simple rules, they are;

1- A simple procedure to develop, operate and maintain the SEZ in India and for setting the unit and conducting business in the SEZ in India

2- To follow a single clearance window of SEZ in India

3- To follow a single clearance window to set up SEZ in India

4- Single clearance window for the Sate Government and Central Government

5- Simplified compliance procedure and documentation laying more of the emphases on self certifications

With all the procedures it becomes equally important that that we are aware about the merits of the SEZ in India. As there are certain relaxations from the government specified for the SEZ in India. The major relaxations of SEZ in India are;

1- Relax on the custom or excise duty for development of SEZ in India on operating approved by the Board of Approvals

2- Relaxation on minimum alternative tax on SEZ in India

3- Relaxation on dividend distribution

4- Relaxation on not only the Central tax but also on State Tax

5- Relaxation on income tax on income raised from the SEZ unit in India

To many of the relaxation there is one point that might help the users of SEZ in India, the income derived from the SEZ in India is 100% relaxed on export income for the first five years after which it is 50% for the next five years and thereafter 50% implementing the same procedure on profits for the next five years. With all the merits there has been a major employment of the SEZ in India, these would include companies like – Nokia, Quark City, Flextronics, Mahindra World City, Motorola, Apache, Divvy’s laboratory, Rajiv Gandhi Technology Park, Hyderabad Gems Limited and among others.

The capital values have also soared to Rs 10-11,000 per sq. ft at Sector 17 and 19. Prices at Sector 22, however, are quite moderate at Rs 6-7 per sq. ft.

Amusement parks can be fun. But what could be more traumatic than to face a life-changing accident when you’re supposed to be having fun? Usually, amusement park accidents happen due to:

 

• lack or insufficient ride safety instructions

• poor maintenance

• negligence on the part of the amusement park

• the rider’s health condition

• negligence on the part of the guests

 

Amusement park accidents can result in serious bodily harm or injury to a person. He/she can be a guest or a worker. In 2005, there were more than 15,000 amusement ride-related injuries in the US according to the Consumer Product Safety Commission (CPSC). The most common injuries include:

 

• contusion, abrasion

• strain or sprain

• laceration

• fracture

• concussion

• internal organ injury

 

The Consumer Product Safety Act defines amusement ride as “any mechanical device which carries or conveys passengers along, around, or over a fixed or restricted route within a defined area for the purpose of giving its passengers amusement, which is customarily controlled or directed by an individual who is employed for that purpose and who is not a consumer with respect to that device…”

 

An in-depth investigation conducted by the CPSC revealed several hazard patterns associated with amusement ride-related incidents.

 

Mechanical failures – These include missing safety pins, broken welds or structural components, exposed electrical wires, broken drive chains, malfunctioning lap bars or other safety restraints, failure to shutoff, improper detachment of cars and improper detachment of structural components.

 

Operator behaviors – These include abruptly stopping the ride following an apparent mechanical failure, improperly assembling or maintaining the ride and defeating safety equipment such as brakes and automatic overheat cutoff switches.

 

Consumer behaviors – These include intentionally rocking cars, standing up, defeating safety restraints, sitting improperly such as sideways or with feet above lap bar, holding a child above the safety restraint, and in one instance, a disembarking passenger intentionally restarted the ride by pressing the start button as other passengers were disembarking.

 

Others – Include rides that can injure people while apparently functioning normally, without an unusual or inappropriate behavior on the part of consumers or operators. An example is a hand-powered ride called the “Spaceball” in which the occupant is spun extremely rapidly. Five reports of eye hemorrhage and one report of retinal tear and possible cerebral edema were associated with this ride.

 

CPSC files document reported cases of amusement ride-related cerebral and retinal hemorrhage, subdural hematoma, loss of consciousness, headache and dizziness. Fatalities with little or no overt trauma have occurred during or after rides which induce abrupt changes in speed and direction.

 

For injuries sustained by guests, the law holds the owner or operator of amusement parks responsible under any of the following:

 

• negligence or tort

• product liability

• premises liability

 

Once liability is established, the victim will be entitled to compensation. The amount awarded may vary depending on the degree of negligence and the extent of the injury or loss.
